$300 Unemployment in New COVID Stimulus Bill vs. Retroactive Lump Sum Payments under Lost Wage Assistance (LWA) Program

A New $300 supplementary unemployment payment in 2021?

As part of ongoing discussions around an extension to unemployment benefits in the latest stimulus bill, lawmakers are reaching consensus on a supplementary $300 payment for up to 12 weeks between Jan 2021 and March 2021. This will likely work similar to the LWA program (details below). Details on how this will be managed and if any additional eligibility criteria are still to be released, but it is highly likely this payment will start in New Year. I will post updates as more information comes to hand.

[Lost Wages Assistance Program updates] With the expiration of the FPUC program and the $600 weekly payment at the end of July, many unemployed or underemployed individuals were left high and dry until the LWA program was put in place via President Trump’s Executive order. The Lost Wages Assistance (LWA) program is in effect from August 1st to the last week in December, but per the table below states are now paying out under this program but will likely take several weeks for some state UI agencies – who are administering the payments along with other enhanced benefits – to update their systems and start making payments.

All states that applied and were approved by FEMA were only awarded three weeks of initial funding– covering the weeks of August 1st, 8th and August 15th.  FEMA will then approve additional weeks of funding for LWA payments on a week by week basis (states have to apply for this). However any additional funding is subject to the $44 billion budget that is available for this program and it is almost certain that funding will run out before the December 27th expiry of this program, unless Congress approves additional funding via a formal UI benefits extension. At this stage FEMA has advised only a maximum of 6 weeks of funding has been approved for most states.

However the good news per DOL and FEMA guidelines is that, similar to the $600 FPUC payments, this payment will be made retroactive to August 1 (week of July 26th). So even though some states will likely take until late September to make these payments they will be making retroactive back payments back to the first week of August if you qualified for the payment.

Retroactive back payments for the initially funded three weeks will likely be paid in one lump sum – up to $900 if you are eligible for all weeks this program is in effect. Additional retroactive payments will be made for weeks the states have approved funding. E.g states who started paying out in mid-September (like Maryland) made the full $1800 payment to eligible recipients. Retroactive back payments however are not guaranteed for new claimants, those who certify late or those with claim issues, since funding is only provided on a weekly basis by FEMA.

Another important point to note is that unlike the $600 payment, the $300 or $400 LWA payment requires a claimant to be getting at least $100 of unemployment benefits from existing federal and/or state programs. This is significantly different to the $1 requirement for the $600 FPUC program. You will likely need to certify on a weekly or bi-weekly certification period that you meet this minimum threshold to get retroactive payments. The $100 minimum threshold is based on the claimants base period for calculating unemployment insurance benefits. For example in California, a person would need to have earned at least $2,574.01 in a qualifying quarter to receive at least $100 in weekly unemployment benefits from the state.

When do the $300 to 400 unemployment benefit (including retroactive) payments start in my state?

The table below provides the actual and estimated (when no official date available) for when the $300 (or $400 in certain states) payment will be made. This includes retroactive back payments, which will be paid along with regular weekly unemployment benefits. Also its important to know that the $300 payment may be staggered in several states (e.g CA, PA, NY) due to the large volume of claimants. So if you see your state with a status of paying now and a date in the past, just know that your payment is likely scheduled to be processed (assuming you are eligible and had certified) and may take a few days after the listed date. And as always, check your state’s UI portal or official emails for your specific payment details.

Phase 2 Staggered LWA Payments – CA, NY, PA, NC

Due to the volume of payments and the fact that FEMA is approving/funding for remaining weeks (following the initial 3 week grant) several state like California and New York are paying the last few weeks of the LWA program. You can see this noted in the table (where specific dates have been published) and across the many comments below. So if you do see a delay between your first and subsequent rounds of payment it is likely due to the staggered nature of payments. Unfortunately states have not always been clear on the timing for these “phase 2” payments as they are dependent of FEMA approval/funding and internal processing so many eligible claimants are facing delays in getting all their LWA payments.

Payment Start date is when the state actually started processing LWA payments OR is the estimated date of the first payment processing based on available information. Because there there is no requirement under the Lost Wages Assistance program that an individual’s job separation be directly related to COVID-19 (indirect association is acceptable under self certification) many more individuals may qualify for this program (vs PUA). The end date for this program, assuming funding is available is December 27th 2020.

  1. I live in Nevada and will be going back to work mid September (after being furloughed since march) will I still receive the LWA payments retroactively for August and the beginning of September if I have to stop filing unemployment before the funds are released to my state?

      • Hang tight Travis….wait till your next payment request to find out. It is so frustrating. In Texas it was a 3 week request for these Federal funds and then another 3 week request for Texas to receive funds and distribute.

I’ve never felt so low in spirit saying I’m an American and I believe in wat this country stand for and it all starts with the President of this nation. I’ve never experienced a president that Was so involved with affairs that’s not a political issue Trump has devided this country and created a lot of the racial differences we’re experiencing Let the elected leader’s run there states and stop treating them like children.       On September 7, 2020, we will begin processing LWA payments to eligible claimants in two phases.

      Phase 1
      If you indicated that you were unemployed or partially unemployed due to COVID-19 when filing for unemployment, whether it was regular Unemployment Insurance or Pandemic Unemployment Assistance, you will automatically receive LWA payments. No further action is needed.

      The payments will be added to your regular unemployment amount for any eligible weeks. Payments will be issued retroactively for weeks that you have already received unemployment benefits, beginning July 26.

      Phase 2
      If you did not indicate that you were unemployed or partially unemployed due to COVID-19 when you filed for unemployment, you must provide a one-time certification.

      We will send you a time-sensitive notice, the Lost Wages Assistance Self-Certification (DE 4365LWA), in the mail or to your personal email, asking you to provide information in UI OnlineSM. Complete the information as soon possible. You might not receive LWA payments if you respond late or if the funding for this program becomes unavailable. For faster service and prompt notifications, register in UI Online.

      If we find that you are not eligible, you will receive a Notice of Determination for Lost Wages Assistance (LWA) Program

          And based on the Montana Department of Labor & Industry, Governor Steve Bullock announced [on August 26th] the Montana Department of Labor & Industry is now issuing the $400 weekly payment through the Lost Wages Assistance Program for Montanans filing for unemployment benefits due to COVID-19. For the benefit week ending August 29, claimants will see a new question on the weekly payment request form asking if their unemployment or partial unemployment for that week was due to disruptions caused by COVID-19. If they answer “yes”, they will also qualify for the additional $400 payment for that week. According to the federal guidance issued for this program, all Pandemic Unemployment Assistance claims are deemed to qualify for $400 payments and those payments will start going out next week.

          For Louisiana – Approximately 400,000 eligible unemployment insurance claimants will receive weekly Lost Wage Assistance (LWA) payments beginning tomorrow, Wednesday (Aug. 26). The retroactive payments will include the weeks ending August 1, August 8 and August 15, 2020. All claimants need to continue to file their weekly certifications in order to be eligible for future weekly benefits.

          I got the $900 and 1 week for $300 which is just 4 weeks of payment but after that I haven’t received the last 2 weeks of the $300 and Lex had told me that it was only for the month of August which is four weeks but I read about my governor put in a request for sep 5 and only 92% got paid for the 5week so why I didn’t get mine. I live in louisiana

        • I live in Arkansas but I draw pua but I am self employed so I draw the min. Which is 132. Have you applied for pua? I also know if you don’t draw enough to get the lwa that they’ve set aside funds on TANF for people that aren’t eligible you should call DHS amd ask them if you can qualify under TANF, however if you lost your job from covid you should be able to switch to PUA. Pua.arkansas.gov hope that helps you

  4. As of this week. Week ending Aug 30 in NH. When I filed, I was asked to self attest for the additional $300. I am hoping this means that it should be coming this week for us now. Has anyone else had this self attest at filing

    • I saw the same thing when I filed last week. And I just read retroactive payments will begin to go out Sept 10. But we’ll only get retroactive payments for Aug 1,8 and 15th. I’m not sure what happens next.

        • I updated it as appears payments have not started yet and so moved it out by a couple of weeks when it is more likely to be paid. If you hear it being paid sooner (or later) please let me know and note the source.

        • They have no idea. I’m convinced that table is a bunch of guesses and when it’s correct it’s simply a coincide. Other than that it’s a bunch of educated guesses. I haven’t seen a reputable source from any Michigan government office make any statement as to when we will receive the LWA except for 1 and he said 3 to 4 weeks. Hopefully it will be sooner in praying it will be sooner but the 13th is more than likely true.

  5. I have the same question as DColeman. Could Andy or others help clarify the answer? Just to be clear, I filed for and received unemployment (including the $600 fed CARES supplement) during July and August. I started working partially this week and will work full time beginning this upcoming week, so I need to stop filing my weekly unemployment claims. The eligibility for the retroactive $300 seems to require that one is still filing for unemployment the week(s) that the $300 becomes available in your state to receive the $300 and the retroactive $300 past payments. Is the correct or incorrect? Also, what if my state requires me to re-self-certify that I am (or was) unemployed due to the coronavirus? How could I re-self-certify if I am no longer filing weekly claims? I am worried that the $300 “Lost Wages Assistance” program requires me to still be filing weekly claims when it become available in my state. Can someone please explain the alternative interpretation (that I desperately need) according to which I will still receive the retroactive payments even if I stop filing weekly claims now, before my state starts the $300 payments (and the $300 retroactive payments)?

  8. Blame the Senate on this one not Congress!!! Blame Mitch McConley !!! Congress on May 15th passed the Heroes Act of which a continuation of $600 week in PUA would be included till end of 2020…. It needed to pass Senate now and Mitch marked the request as DOA( DEAD ON ARRIVAL) So with the passing of George Floyd and all that followed it held up for a few months the compromization talks between Senate and Congress. Senate only wanted to give $200 week and Congress stood firm on the PUA being $600 weekly so…… Trump did the Executive Orders instead. Also included in those 4 orders that day was get rid of that Paycheck Protection Plan which a person might think that has to do with UI….WRONG it doesn’t ….it is your Social Security Tax that you pay your whole life in order to retire and have your Social Security check and Medicare.   11. August 1 , 8, 22, and now 29 now still no $300.00 my state says could take to get the checks out for 4 to 6 weeks do we get all them checks while we’re waiting till August 1 retroactive or just the the 3 in August 1st 8th and 22?

    • Yes, I updated based on information that is made available to try and get a better estimated date of payment. Currently FEMA estimates 2 to 3 weeks for states to update systems and make this payout. Hence the date for Alabama. But check the state UI site for the latest information.

      • Texas has started to pay out the $300 extra through UI. I even received back pay of $300 from week of July 26th when the original PUA of $600 stopped. I thought under Cares Act that UI was extending 13 weeks. I am at 24 weeks and there is not enough in my UI account to pay that week. I researched about the extended 13 weeks and came up with you can only receive if unemployment rates are at a certain level. So Texas is within the range but I don’t see enough funds in my case to continue with Texas U.I. I am still furloughed from my job and if no more payments then I would have no more income !! Where do I go from here????

        • I did receive the PUA of $600 weekly until it stopped July25th. Now I continue with the LWA $300 weekly. I started with Texas UI late March when all this CV19 happened and was furloughed from work. I am on week 25 and it looks like there are not enough funds in my originally work up to continue. Where does the 13 week extension come into play and will I see that amount in Claim and Benefits page of the Texas UI? It is impossible to get a hold of anyone by phone…..does anyone now that answer please?????

West Virgina just got approved by FEMA, They announced that the FEMA disaster relief funds will cover $300 of the new weekly payment, and the other $100 will come from West Virginia’s allocation of the federal CARES Act Coronavirus Relief Fund. This will provide a total of $400 of extra weekly unemployment benefits until FEMA funding is available.

  14. My question is this. I live in Lousiana, and from everything I’ve read it appears that the LWA payments are to start here the week of Aug 24th. I filed for my weekly benefits, and the Louisiana unemployment site shows me receiving the same 107 per week that I’ve already been receiving. The retro payment of 900, for the weeks Aug 1st, 8th, and 15th, will that be coming separate from my normal payment, and also, will I receive this via direct deposit(which I already have) or will they be mailing a paper check? I am praying its via direct deposit…any info anyone can give would be greatly appreciated!! Thank you!

    • Direct deposit- same as your current payment is what most states are doing. Payment dates are still not firm – just estimates.

    • I’m in NC i got my $900 for those three weeks on Tuesday Sep8 and it comes as a separate deposit you will see it. If you have direct deposit it will come that way, they have all taken their sweet time if you ask me. They act as if ppl arent in critical need smh. Our state shows now approval for aug 22. Where is the payment it hasnt shown up yet.

  16. My company waited until the $600 was done to do a reduction in force and now the South Carolina Governor is dragging his feet. So now I am supposed to pay bills on $270 a week after taxes. Ridiculous.

    • Updated to Sep 15 per guidance from MA UI – Massachusetts’ application to receive grant funding to pay an additional weekly unemployment benefit to claimants under the federal Lost Wages Supplemental Payment Assistance (LWA) program has been approved by the Federal Emergency Management Agency (FEMA). The application was submitted late last week by the Massachusetts Emergency Management Agency (MEMA), in coordination with the Department of Unemployment Assistance (DUA).

      Per FEMA’s authorization, the grant will fund an additional $300 weekly payment to those who are eligible for the three weeks ending 8/1/20, 8/8/20, and 8/15/20. The Massachusetts Department of Unemployment Assistance has already begun work on the technology requirements necessary for this program and anticipates being able to quickly deliver retroactive funds to eligible claimants for those weeks by Sept. 15. Eligible claimants currently receiving benefits do not need to take any action because the Commonwealth will automatically add LWA to their weekly benefit payment retroactive to the dates they are eligible.

      • Please please please tell me. I got $146 on MA UI weeks ending 8/1 and 8/8, I went back to work on 8/10 so case is currently closed. Will I get the 2 payments of $300 ea to make up for the missing FPUC Weeks come 9/15 or am I ineligible bc I went back to work?     • Gov. Jim Justice has directed WorkForce West Virginia to apply for the Lost Wages Assistance Payments grant through the Federal Emergency Management Administration, according to a press release.

      Upon approval by FEMA, this grant will allow WorkForce West Virginia to provide an additional $400 per week in assistance funding to those receiving Unemployment Insurance benefits due to COVID-related impacts.

  20. My sister in Florida has yet to receive all her PUA payments from the PUA under Cares Act. She has been back to work for past 2 months but no retro pay of $600 PUA weekly. Why is this. I had no issues collecting in Texas.

        • I found it online based on state official quotes or used DOL guidelines that it takes states 3 to 4 weeks to update systems to make payouts. Arizona and Texas are the only ones confirmed for making payments (as of Aug 24th)

    • Yes…GA was approved on Aug 23rd for the program. Expect them to start paying benefits in 2 to 3 weeks, and probably a bit longer for retroactive payments.

        • I thought under Cares Act if you go back to work before it was approved you dont get the pandemic relief. I heard that was a requirement to get the pandemic your still unemployed, in order to receive it. If she didnt have reg UI benefits and only PAU then you become disqualified upon returning to work, since PUA requires you to be unemployed.

    • Table was updated. As of August 22nd, SC has not been approved for the LWA program to pay extra weekly UI Benefits. Gov. Henry McMaster’ rep said he is “continuing to analyze the program and the President’s order as we determine what’s in the best interest of South Carolinians.”

    • I agree, I feel since this whole Covid 19 all these political figures care more about who’s side makes sense, dems or reps and they act as if all these ppl on unemployment arent suffering. It shouldn’t take as long as it is for them to agree about the second stimulus package that outlines all the benefit programs to help Americans. It’s so ridiculous I’m disgusted with this nation.

  26. Just found out yesterday via email from the NYS DOL that New York has applied for the LWA. Now it’s just waiting for FEMA approval.

    • Correct. — New York State’s budget director now says New York will apply for lost wages assistance program because the federal government is no longer making states provide part of the funding. Governor Cuomo was not initially going to apply.

      Note – The table in this article shows approved states per FEMA (as of August 222nd) and since NY has only applied, and not yet approved, its not on the list.

        • Not approved by FEMA as of Aug 24th. But word is they have applied so should get approval soon.

      • Andy, do you know anything about the 13 week extension that was part of Cares Act back in April ? I am at week 26 with only half a payment left , when does that get added in ? I am in Texas…Thank you

        • Update on 13 week extension in Texas. I had only $64 in my UI account left on the 26th week. Did a payment request not knowing where it would take me. Texas gave the last of my funds $64 and $300 LWA but nothing for the second week. The Extension benefits did not auto roll in. My account has $0 funds. So where does one go from here? Do I appeal? Impossible to get answer by phone….. I will try in person at TWC since I live in a smaller town. So be prepared folks for it to come to an end or LOONNGG pause………

        • Newest Update…. So Texas did deposit a 13 week extension into my Claim/Payment account and paid the week that they actually owed plus continue with LWA $300 week . Just takes system a moment to catch up when your regular UI runs out. For Texas when that 13 week extension runs out an additional 7 weeks will add on.

      • Mississippi Department of Employment Security (MDES) has said it will implement the program and funds will be available within three to four weeks (after FEMA approved it on Aug 22nd). FEMA has assured the states that money for three weeks will be available to pay claims for the weeks ending August 1, 8, and 15, 2020. Additional FEMA grants are provided after that subject to funding. MDES will implement the program and funds should be available within three to four weeks. Hence the estimated Sep 13th date. I will update if it does get paid sooner or delayed further.

          In addition, each state has to request from FEMA the additional weeks in order to get funding past Aug1,8, and 15. It is not automatic, the only state that has been proactive since this executive order is Arizona and that’s where I’m from but now live in NC. AZ has been paying ssd since Aug 17. faithfully I dont know why all the other states dragging like they are seriously.

  28. I am still waiting to get my PUA from April! There are thousands of us in NV that have not been paid a dime, it just says pending. I have sent numerous emails, called 20 times a day and can’t get through. They said I will be getting $181 a week, that was in June but nothing! I don’t know what to do.

      When I applied in may 17 I didnt get my first check till july9 my claim literally sat there due to overwhelming demand of benefits and so many calls waiting for hours and hours finally spoke to a supervisor and my back pay and everything was done in 24 hours and deposited to my account. Very ridiculous.

  29. Wow! It’s shameful that New York State did not enroll even just for the $300. Even with our coronavirus deaths and recent cases considerably low, there are still many people without work and that extra money would help.

    • Another Cuomo political stunt. Maybe he can humorously discuss it with his Mother and brother on national TV to make us feel like he is concerned and doing something. There are a bunch of us out here still unemployed while the politicians still enjoy a paycheck and personal protection at taxpayer expense during Covid and now the Marxist takeover of the streets.

      • Actually, Cumo is doing the right thing. I just found out he refused for the State of New York to accept Trump’s deal because he believes it is unconstitutional and illegal. Spending some time at the law library at S.U. I did note that everything that Trump has done to make this into an executive order and have the states pick up the tab for the remaining $100 is unlawful. In short, his executive order is as useless as a ropeless skipping rope.

        • All we can do is hold tight and hope for the best but prepare for the worst. I’ve learned to not depend on a anyone this includes our Government. I suggest everyone take advantage of any and all programs available in their states whether its job training or education as unemployment is just a bandaid that barely covers the wound.by the time I receive anything it goes right out . And Andy I seen on the L & I page for Pa. That people will start to see payment of LWA as early as September 14th,,Best wishes for all of us,

        • Well said ….it is a bandaid…. too bad we don’t have the whole first aide kit !! Get creative apply for SNAP ,it provides full amount of $194 person till UI rate drops below 5% and currently Texas is at 12% as well as most states. EB benefits run the same way. Seek your local churches , community centers etc. Good Luck!!
