[Congress Impasse] Congress continues to be at an impasse on agreeing to a stimulus package that would have included a second stimulus check. The main hold up is around the size of the stimulus package – Republicans want a smaller $1 trillion package vs $3 trillion that Democrats proposed under their HEROS act bill. Until this is resolved, another stimulus check payment won’t be made. I will continue to monitor this and update when new information is available.

[Second Stimulus Check Update] Congressional leaders have agreed in principle that a second stimulus check will be paid in 2020, given the ongoing economic fallout from the COVID crisis. This CARES 2 economic impact payment (a.k.a stimulus check) will be part of the next stimulus package, which is still under review due to several other politically contentious items (like an extension of unemployment benefits). However another round of one-time stimulus check payments seems to be agreed upon by Republicans and Democrats, and the general consensus is for a $1200/$2400 payment in August.

Some proposals had the stimulus check as low as $600, all the way to a recurring $2,000 monthly payment! Income eligibility levels are also set to remain the same as the first stimulus check (detailed below) and based on 2019 or 2018 tax returns. Further another $500 child stimulus payment will also be made and will be expanded to cover those under 24 (versus under 17 in the first stimulus payment), so high school and college age dependents would be covered.

The stimulus payments are expected to be paid soon after the final stimulus package is approved by Congress and the White House. The first round of checks was plagued by problems as the IRS had to update systems, account for non-filers and work with several other agencies to verify payments. Luckily that is now in place so I expect the payments to be much more efficient this time around and hit most people’s bank accounts by late August.

For those waiting for their first round of stimulus payment, the IRS is still recommending these be claimed in their 2020 tax returns filed in 2021. This would also apply for those who don’t receive their second stimulus check.


[June 2020] The $2 trillion dollar stimulus bill (CARES act) has now been signed into law. Under this bill there is the widely reported economic stimulus payment checks of $1,200 per adult and $2400 for couples. For families they would provide $500 for every eligible child. The full stimulus check would be made to those earning less than $75,000 ($150,000 for couples) and would phase out to zero for those earning more than $99,000 ($198,000 for couples). Head of household tax filers will get the full payment if they earned $112,500 or less.

In the phase out range (i.e. between $75,000 and $99,000 for singles) for every $100 you earn above the lower limit ($75,000) payment drops by $5 until you reach the maximum limit ($99,000).

Example (single) – If Brian made $67,000 last year based on his latest filed tax return, he would get the full $1200 payment. If he had made $90,000 he would only be eligible for $450 ($1200 – $750). If he had made $110,000 he wouldn’t be eligible at all.

Example (married) – My wife and I made $185000. We filed jointly. Are we eligible to get anything from the 2020 stimulus? Answer – You would be eligible to get $650.00 (partial amount) under the direct payment program. Up to $150,000, you get 100% of the $2,400 stimulus payment. Anything over 150,000, you would subtract 5% of the amount over $150,000. So in your scenario, 35k over 150k. 5% of 35k is $1750, So $2400- $1750=$650.00

In addition to the above income limits to qualify for the $1200 or $2400 Economic stimulus check (or economic impact payment per IRS), recipients must have a valid Social Security number and cannot be claimed as a dependent of another taxpayer,

Roughly three-quarters of people who are eligible for a $1,200 stimulus payment from the federal government have received it, according to the Treasury Department.

The IRS has said that distribution of economic impact payments is nearly 75% complete and will be distributed automatically, with no action required for most people. People with the lowest incomes will get their checks first and should already be seeing these payments in their accounts. Actual check payments take longer. The IRS also has a tool to check payment status, but be warned that this has been having issues providing accurate data and payment status. Millions of Americans have also started receiving their IRS Economic Impact Payment (EIP) letters outlining details of their stimulus payments. It provides details of the payment and a number to call, but don’t get your hopes up. At least not at this point. The number is just an automatic system giving a long message about what and who qualifies, and there are options to listen to more messages but that’s it.

If you haven’t already make sure you file your tax return (deadline extended to July 15, 2020) to ensure you get the 2020 stimulus check payment in addition to the extended and additional UI benefits. You can file for free at Turbotax and even at the IRS if you make below certain income limits.

IRS Economic Impact Payments

Child or Dependent Qualification for the $500 payment?

Several readers have asked questions around the $500 child dependent additional stimulus payment. To get this payment you must have filed a 2018 or 2019 tax return and claimed the child as dependent AND the child must be younger than 17-years-old at the end of 2020. They must also be related to you by blood, marriage, or adoption (similar to the Child Tax Credit). There is no limit to the number of dependents who can qualify for the additional $500 in one household.

This age limit is much younger than what is used by the IRS in the qualifying child test where a child must be younger than 19 years old or be a “student” younger than 24 years old as of the end of the calendar year. Hence the confusion being caused by this. So just remember if your child or eligible dependent is 17 or over you cannot claim the stimulus payment for them.

College Kids and High School Seniors

The younger than 17 yr old requirement has ruled out several thousand college students and high school kids who are older than 17, but still being claimed as a dependent by their parents on their federal tax return.

However if you are a college student AND filed a recent tax return you can qualify for a standard/adult stimulus check per the above eligibility rules. But note as soon as you file a return you cannot be claimed as a dependent by others, which means they lose certain other tax benefits and credits.

What about on Social Security or SSDI (Disability)?

Social Security recipients, disability (SSDI), Survivor Beneficiaries and Railroad Retirees who are not otherwise required to file a tax return will also be eligible for the stimulus payments, as long as their total income does not exceed the eligibility income limits above. The IRS in conjunction with the Treasury and Social Security Administration announced that recipients of Supplemental Security Income (SSI) will automatically receive the $1200 Stimulus Check (formally called Economic Impact Payments). See details here. This group of recipients will receive the stimulus check the same way they currently get their federal benefits in early May with no further action needed on their part.

However note that because the IRS has no information regarding dependent data for this group of recipients, the $500 kid dependent stimulus payment would not be automatically paid to this group. They need to use the non-filers tool on the IRS website to claim this.

How will the Stimulus check payments be made by the IRS?

[IRS Updates] – The IRS has confirmed that payments for most working Americans are expected to be calculated and deposited or mailed via check based on 2018 or 2019 federal tax filing payment details. Most people won’t need to take any action and the IRS will calculate and automatically send the economic stimulus payment to those eligible. The Treasury department, under which the IRS falls has also created a website/portal for those who are not required to file U.S. income taxes or who have to change payment information (e.g direct deposit information).

For those who have not yet filed their return for 2019, the IRS will use information from their 2018 tax filing to calculate the payment. The economic impact payment will be deposited directly into the same banking account reflected on the last valid return filed. So if your 2018 information is out of date or your income situation changed in 2019, make sure you file, even if you have no taxes due (start filing for free with TurboTax).

2020 Stimulus Check Payout Schedule

The IRS has confirmed that the distribution of economic impact payments (stimulus checks) has started and millions of Americans should have their stimulus check payment by now. Note that this will likely only apply to those receiving the payment via direct deposit (in line with how they get their tax refund or Social security check today). You can see the status of your stimulus check payment on the IRS Get My Payment portal.

  • Direct Deposit payments will generally be deposited 2 to 3 days after the IRS confirms income eligibility for the payout.
  • Physical checks will take at least 6 to 8 weeks to be mailed out.

Social Security Retirees and Disability recipients who are eligible for the payment will get the stimulus checks/payments deposited the same way they currently get their payments.

Given over 120 million Americans could be eligible for the payment, it will take a while to process the stimulus checks.

Stimulus Check Missing Payment Issues or Errors?

The IRS will also be mailing Stimulus Payment letters to each eligible recipient’s last known address 15 days after the payment is made. The letter will provide information on how the Payment was made and how to report any failure to receive the Payment. Note that the IRS or other government departments will not contact you about your stimulus check payment details either.

Why didn’t I get a stimulus check? Remember that the IRS has to have your direct deposit details, which is normally only provided if you received a 2018 or 2019 refund. If you file a return and they cannot use their portal to add direct deposit details, then your payment will come via check which could take several weeks. At this checks will likely start arriving at your IRS registered address from the end of April.

Finally you will also likely be able to claim any missing payments in your 2020 tax return as a tax credit. All this unfortunately will mean delays in getting your stimulus payment until issues are worked through.

How will child support arrears and payments be impacted with stimulus check?

I seem to be getting a lot of comments on this question around child support. The IRS has confirmed (see q21) that the stimulus check payment will NOT be offset or intercepted for those owe tax, have a payment agreement or owe other federal or state debts. It will however be OFFSET for past-due child support. This is because a court order for child support continues until it is modified or terminated. Similarly with unemployment compensation stimulus increases, your child support may be withheld from the UI payments. You will get a notice from BFS if this happens.

Injured Spouse Claim and Spousal Claims

The IRS also stated that If you are married filing jointly and you filed an injured spouse claim with your 2019 tax return (or 2018 tax return if you haven’t filed your 2019 tax return), half of the total payment will be sent to each spouse and your spouse’s stimulus check payment will be offset only for past-due child support. There is no need to file another injured spouse claim for the payment. I have received dozens of comments on this this, so hopefully this answers the questions many have had based on official IRS guidance.

Note that if you were current with your child support payments at the time of the stimulus eligibility determination (end of March) but fell behind afterwards due to a COVID-19 related job loss, you would still be eligible to get the full stimulus payment.

Updating Direct Deposit Information

This question has come up a lot in the hundreds of comments to this article. The IRS has setup a portal for individuals to provide their updated banking information to receive payments via direct deposit as opposed to checks in the mail. The IRS does recommend that 2018 Filers who need to change their account information or mailing address, file 2019 taxes electronically as soon as possible. That is the only way to let us know your new information. You can file for free via TurboTax.

If your bank account details changed, was closed or no longer active (so payment is rejected by the bank) a check will be mailed to the address the IRS has have on file for you based on your most recent tax return or as updated through the United States Postal Service (USPS). You cannot call the IRS to update payment or address details at this point in time.

Do I have to pay taxes on my stimulus payment?

No. Since the stimulus check is considered a refundable tax credit, it is not classified as earned income. Hence not considered taxable income you will have to report in your 2020 tax return (filed in 2021). It also won’t affect your income for purposes of determining eligibility for federal government assistance or benefit programs.

This payment also does not have to be paid back if any over payment happens or your gross income in 2020 changes. This includes your income rising to above the qualifying thresholds. If you unexpectedly got the payment, congratulations! You get to keep it now.

Returning Incorrect Stimulus Check Payments

A few people have commented that a spouse, relative or child who died since they filed a 2018 or 2019 tax return received a stimulus check payment. The IRS has provided official guidance on this issue which states that any payments made to someone who died before receipt of the payment should be returned to the IRS in full.  The exception to this is for payments made to joint filers and one spouse who had not died before receipt of the Payment, in which case, you only need to return the portion of the Payment made on account of the decedent

Why you DID NOT Qualify for a Stimulus Check (Economic Impact Payment)

Several people have commented that they have not received or not gotten the correct amount on their stimulus checks. The IRS has provided the following reasons –

  • Your adjusted gross income in your most recent tax filing approved by the IRS was greater than than the limits shown above, which are
    $99,000 (single or married filing separately status)
    $136,500 (head of household filing status)
    $198,000 (married filing jointly status)
  • You CANNOT be claimed as a dependent on someone else’s return. This includes as a child child, student or older dependent. (But those under 17 dependents can get a $500 dependent stimulus)
  • You don’t have a valid Social Security number and/or are a nonresident alien.
  • You filed Form 1040-NR or Form 1040NR-EZ, Form 1040-PR or Form 1040-SS for 2019. These are quick filing forms, but you need a standard filing (e.g via TurboTax)

  5. My wife and I have been seperated for more than a year and I am on social security diability. How do I stop her from getting my part of stimulus because she will not let me know if she gets it and she will try to keep it all. I called her about the first stimulus check and she went crazy because I told her that I know the check had been sent and I told the post office to be watch for it, which they did let me know when they did get a letter from IRS and I contacted her and let her know we did get a letter from the IRS and the post office has it and that we both had to go and pick it up. She was really mad because I think she filled her income taxes and put me on it which I should not have been on it because I did not agree nor did I sign for any income tax return jointly or any other tax return for 2019 or 2020 and she should not have included me with her tax return. We did go together and did get the check cashed and I got my half of the stimulus check. My question is, what do I have to do to find out if she did do her taxes jointly which included me with out my signature, because I tried to find out but it ask for her social security number and mine and I do not know hers and she will not tell me so I cannot find out and what do I have to do so if we do get a second stimulus check I will get my seperate from her, so she does not get it all because she will not let me know if she does get it? If it was not for checking and finding out a check was sent and when it was to be sent, I would not had gotten my half if I had not gotten a hold of the post office because she would have cashed it without me signing it.

    For the first stimulus check my husband (which receives benefits from the VA due to being a disabled Vet) he went online and did the non-filers form to add me and my two children(his stepchildren) and put in our joint bank account info. We received what we was suppose to.. My question is I am filing for a divorce,so if they pass a second stimulus package will they go off of what was put in the last time on the non-filers? He will not be residing in the same resident as myself and my children or could I go and do the non-filers for me and my children if they pass it? He will be updating his direct deposit info when he moves to a different bank for his regular payments(which he wi have to remove me and my children off his benefits with the VA once we file for divorce..or will I be able to go and do the non-filers for just me and my children with just my bank account?? It will take a couple months before the divorce would be final. How will that work?? Thanks

    1. My child is 33 and I just started receiving child support 2 years ago. My ex husbands stimulus check was taken but the State of Illinois took it for medical paid on my child when he was under the age of 18. No this is not fair that they took his money then took it from me

        1. I am 51 and raised 4 children without food stamps and worked all of my life!!!!! The only help I ever got was the medical card and he was lazy, didn’t work and received food stamps and always made sure he had a wife that could get cash also so you need to watch who your accusing of lazyness. Lmao. The state of Illinois took the stimulus to cover medical bills and I’m pissed because SO many women sucked the state dry and got their baby daddy’s check and I was married but divorced the bumb because I wasn’t going to support him and our child. So take your stupidity elsewhere and you definitely need to grow up and see the world for what it is….. people living and some trying to have a real life. From your words I would think you are just like my ex and if ANYONE, male or female, makes a child they need to help pay for whatever the child needs. It is not the childs fault but just because one of the parents doesn’t want to be married does not excuse the other from supporting the child. I never went after my ex for child support. The state did for medical. And I supported my son and his 3 siblings, and they all have educations and good jobs and are hard workers

  8. Child support arrearage. i do not think it is fair to take the stimulus money from the people who owe back child support that are not working and have been turned down for the UIA/PUA money. My son was not working when the covid pandemic started, has not gotten unemployment or pandemic money. he was denied both. the mother of his child got, her stimulus for her and her son, got my son’s federal tax check and state tax check, and his first stimulus. she has been working and has gotten bonuses from her employer. their son is on Social Security/diablilty and she gets that money also. but my son gets nothing and gets further behind on his bills.

  10. I am no longer with the man who filed head of household and included my daughter and I. I am struggling and would like to receive funds in the event of another stimulus. As of now he will get it directly deposited into his account. What steps do I need to take for my portion to be deposited in my account and not his? We had separated before the first check and he refused to give me any even though I feel I should have been entitled to it.

  11. I just want to say life isn’t fair. I got my $1200 check. My dependent 22 year old son got $0 because he is still a dependent but older than 16. My husband has an arrears balance for child support that he doesn’t owe because the children lived with him the whole time growing up, however, they took his check. That is 3 people only getting 1 check and we live off my fixed income pension. No inflated unemployment checks for us. Money is tight. So quit whining about your check, some people got nothing and they need to eat too. If all types of debt were not to be offset, child support should not have been offset and just because my son is a dependent should not mean he gets $0, he should have at least got $500 because he has to eat too.

  12. My husband and I filled separate tax returns. I started receiving social security retirement benefits January 15th, 2020. He filed his taxes first, then I filled out the non filers form. I was denied because on!y one person can use the primary social security number, even though we filed separately! What kind of sense does that make?

      Hey if you recieved a message or CD response like you are claiming then your husband claimed you and took your half of the stimulus. He took his 1200 as well as yours. The reason I tell you this is because my girlfriend had this happen with her ex husband because they are still married and have children he was not happy about their separation so I guess he felt a way to get back and recuperate some money he has been paying out for child support he tried pulling s fast on on my girlfriend but luckily I was able to see his paper trail and since we put in a complaint with the IRS. Shes still waiting to hear back but it sounds like she will get the money for herself and her kids likes she originally filed for and planned on and the government will just collect from her ex via tax collection
      I cant tell you why your husband is taking your stimulus but I’d definitely confront him maybe hes cheating on you or is mad your collecting SSI and you have a separate account instead of a joint account. That is a little bizarre especially if he supported you in the past when you were incapable or lacked income to provide for yourself. Hopefully worst case hes not having an affair and is trying to get as much money saved up and together so he can ride off in the sunset with some young mail order smut. Whatever the case I fear it’s not a good scenario and I’d look into it immediately and prepare for the worst. Best of luck

    4. Repeat step 1 and 2 until you start hearing music playing instead of asking you questions.. ( I think it’s like around the 2:10 time of u waiting..
    If you hear music playing u got threw you were one of the chosen ones lol..
    5. I tried 7 times first answer.. I called again to make sure my theory was correct and it took 10 tries.

  15. I received a stimulus direct deposit based on my 2018 taxes. Later I filed my 2019 taxes and based on it, I would have been entitled to a bigger stimulus check. Will the rest of it be included in my 2019 tax refund, come separately, or not at all?

    1. No. You will have to claim this adjustment in your 2020 tax return with supporting documents.

I find it to be amazing that being told that all SSI, Vets and RR would be getting direct deposit into bank accounts and maybe i am slow because every time i check this IRS website i get the same reply, my information does not match theirs, would match because i am retired and get social Security monthly so i guess my question is why is the IRS is not exchanging information with SSA

  17. I am on SSI with no dependants. Was told on the get my payment site that my eip would be deposited on April 29. I have not received it and nothing pending in my bank account. I checked my account and routing number, ssn, and everything was correct

  19. I filed my 2018 and 2019 taxes, always use direct deposit for refunds and use the same banking information for several years. I still have not received my stimulus payment? Any idea why and I do not pay nor do I owe any child support. I have not received my IRS refund either and I filed that on 1/27/2020!!! What gives??? I am a working nurse and feel so slighted.

  20. I’m on SSDI and have been a few years. I have direct deposit but not recieved nothing about the stimulus payment. I went to the irs page and done the get my payment and tried non filier and got no help. What can I do to get answers about when I get my payment if I even do get one

  21. I received a $350 deposit today, which doesn’t make sense. I qualify for $2900. When I go to the Get My Payment tool, it says my payment is scheduled to be deposited tomorrow, May 13. Is it possible this is a partial payment and the rest is coming? Or is this all I can expect? There weren’t any pending deposits listed on my account.

  22. I am a single mom, I haven’t worked or filed taxes in over two years due to personal issues. I have 3 kids my youngest just turned 17 in January and their father passed away a few years ago. My youngest son is still receiving social security survivors benefits but they come in my name as a payee on a direct express card. I used the non filer tool and entered the information we had and I had already opened up a paypal account so I linked it to my direct express card. I have researched and read anything that came from a reliable source and I am still praying I did the right thing. I claimed my son because he was 16 in 2019 and I could not talk to anyone that could tell me exactly what I needed to do. I know I am eligible because I have no income and I meet all the other requirements, I’m just concerned about claiming my son but he is still in highschool and gets benefits we get a SSA 1099 form every year. I submitted it and it said congratulations it was successfully transmitted by the irs. When I go to get my payment status it still says it processing and I still dont know if or when?? I am praying I did the right thing.

    1. Just to let you know non filers who used the non filer for dependants that receive S.S benefits and normally don’t file all got screwed and didn’t get the dependant payment. So you did the right thing, but IRS didn’t process the information even if you met the deadline and even when it said congratulations IRS accepted your return. You will not see the dependant money until 2021 when you file your taxes. And clock the box to say I didn’t receive the child stimulus payment. So now we have to file next year even if our income is under the income threshold, just to get the money.

I am on SSDI and I took the necessary step of adding my dependant information on non filers on 4/12 way before the deadline. Am I going to have to wait till next year to receive it? Even though I don’t receive enough to file taxes. Do I file just to get the money when I neither owe or am due a refund? I don’t think it is fair I followed IRS advisory and did exactly as asked. And NO one else can claim her and my husband passed away in 2018. My daughter is 13 by the way also below 16.

    1. If she is a dependant than she will receive any money. It was only 16 and younger as a dependant. If she filed for herself and nobody can claim her than she could receive $1200 but since her father already claimed her and is most likely already providing financial or room and board or feeding her or possibly paying for college etc she is not eligible. But if her father gives ziltch and you give her zilch in support and she pays her own way 100% than she could file taxes as single filer and since 2 people are claiming her the IRS will send letters to both asking are you sure you have the right to claim this person as a dependant? And she can provide proof she pays her own way.

  30. I used the non-filers tool for my husband and I and we didn’t get any of the stimulas payment because I still have child support arrears I owe my ex. Told we can fill out an injured spouse since it’s not my husbands debt but I am having trouble figuring out exactly how to do it.

    1. Look up the form, print it off, fill it out and mail it in. I claim all of the kids portions as 100% mine on the form. Hopefully this helps.

      1. You can claim injured spouse form and get your and your kids part. They will only take his 1200. I am a tax person and I had to do it cause me and my husband file together.

    1. Do you or your husband owe back child support? Or do you owe any creditors? Those are two of the reasons your money is missing. and if you don’t have those problems you have received it at midnight at your bank on 4/29/20. I received mine and my older son at midnight. However they didn’t give me the $500 for my minor child even though I enter my dependant info on non filer on 4/12. Unfornately you can’t call or Email the IRS even if you receive the confirmation letter. It just gives you some automated mumbo jumbo and refers you to the IRS website which is not helpful.

  35. I finally got my Stimulus of $1200.00 last night. However I am on SSDI and I took the necessary step to enter my dependant on non filers on 4/12 as soon as it went live. The IRS didn’t give me the $500.00 for my dependant. They apparently paid me off SSA info only. So what was the point of Entering your dependant on non filers if you were going to ignore it. The number given to report issues doesn’t work and its just an automated loop.

  36. We both received Benefits Social Security for didability, My wife is disable and I’m too. I’m receiving VA compensation also. She said to me that we only will received $1,200.oo and I own her $600.oo. According for what I read, both are entitled to stimulus check deposit of $1,200.oo each. But because she haven’t received hers jet, she is complain about that. So, the question is, are we will be paid as social security disable person and will received $1,200.oo each, as a married couple total $2,400.oo.         1. If you wife couldn’t log in to give direct deposit info into get my payment or non filers. Then you will be mailed a check. If you have benefits from SSA than will receive it how she normally gets her benefits. i.e.: direct deposit or paper check. She shouldn’t need to do anything if she is on Social Security Benefits.

    1. I have the same question my husband and I filed our taxes jointly and only $1,200 was deposited on our TurboTax debit card that we used for our refund. This was done on the 29th of April however my payment status says that my stimulus payment will be direct deposited on April 30th and to my checking account and that my husband’s payment will be direct deposited into a bank account ending with my social security number. I’m only hoping that the other half of our stimulus payment will show up in my checking account.

I filled a modification back in May of 2016 and apparently it never went through so they took my whole stimulus check from my son and myself and who knows if and when the courts reopen if I’ll be able to get any of that back as well as they took my tax refund so during this hard time of no work and anything me and my son are left so broke it’s ridiculous I’ve tried to call around to child support and everything I’ve been dealing with child support and trying to get this fixed since October and every time I go and try to fix it one points to the other child support says it’s the courts the courts are saying it’s child support so basically I’m getting robbed of my money that’s supposed to be going back into the economy and again I have full custody of my child who the support was for if anybody anybody has anything kind of answers for me please let me know because as of right now I can do nothing I called the treasury I’ve tried to child support helpline and nobody can help me because everything is shut down in a situation like this I feel that they should have a set of people that can work from home or be in the office with limited people to try to fix these things because it’s not right that we are suffering because they can’t fix it or do their job properly I had sent them proof of me having custody of my child back in October when I got a letter saying what to do I did that and went to the courts the courts told me to contact child support which I did and they sent me another letter saying going to the courts I’m at a standstill but I’m at the same time I am being robbed by the government… and not just that they took the stimulus check and my tax refund which equaled well over what I owed and they’re saying that I have to wait 10 to 16 weeks before I even get the remainder back in a time like this that should not apply they should be sending out the remainder right away due to the fact that people need money to stay alive

  41. My stimulus check was garnished for child support arrears. My daughter lives with me and they also took the $500 portion that I qualified for by her living with me and filing her as a dependent. I also recieve survivor benifits for her from her father passing from SSI. So I dont know if that qualifies her for the next round of checks. I am a restuarant worker and trying to get unemployment in Florida is difficult. I just can’t believe the government would take the qualifying child portion of the stimulus when she lives with me.

  42. I owe back child support, but my husband does not, we filed an injured spouse claim form with our taxes back in February. I receive a letter from the IRS the full amount of our stimulus was applied to the child support. I called the child support enforcement number as stated in the letter, but long story short, I was informed just a few minutes ago by Child Support Enforcement, you DO have to file another Injured Spouse Form 8379 if my husband wants his portion of it back.

    We had a court ordered self pay order from the child support court back in 2005. Child support had added every week of payments ever since but won’t take away a license or put charges forward. We have to hire an attorney to fix it.

I file injured spouse every year. Will child support intercept our entire household stimulus? And if they do what is the process to claim mine and our children’s portion?

    1. They took all of ours $3900 and i’ve filed as injured spouse for 10 years.
      They say to contact the child support division once you receive the letter
      that your money was taken for child support

      1. I called the offset line and it said my husband’s will be offset by 1950. I called and then put my social in and I have zero offsets.

      2. Hey Ali, Join our facebook group there is a lot of good information. We have been closely monitoring this situation with child support and injured spouse filers. In summary we believe there was a systematic glitch at the IRS resulting in the error of the 100% offset instead of the 50% offset for the stimulus. There have been cases where even tax refunds have been 100% offset when normally the IS spouses has normally gotten their share of the refund. All we can do is wait for the IRS to open up and speak to a live person. But right now it seems like they are aware of the situation.

What should I do? I also have full custody of both of my children but only $1700 was deposited.     1. I live in Missouri. I have file injured spouse since we were married and all of our stimulus was taken for back child support. You’ll get a letter once they have taken the money and you have time to contest it through child support.
